Florida AOB Update: Assignment of Benefits Banned for Property Insurance (Replaced)

Florida banned Assignment of Benefits for property insurance restoration claims. Senate Bill 2A, signed in December 2022 and effective January 1, 2023, made AOBs void and unenforceable for any residential property insurance policy and any commercial property insurance policy issued on or after that date. The vast majority of Florida property owners are now under post-ban policies.

What Replaced AOB

Restoration contractors and homeowners coordinate insurance claims through:

  • Direction to Pay: The carrier mails the claim check directly to the contractor. The homeowner keeps all claim rights and decision authority.
  • Standard contractor invoicing: The contractor invoices the homeowner, the homeowner submits to the carrier, the carrier pays the homeowner, and the homeowner pays the contractor.

What WrightWay Does
